There are no federal statutes regarding tattoos and tattoo shops, but every state has their own rules and regulations when it comes to tattoos and tattooing. Some states will not allow anyone under the age of 18 to be tattooed regardless of circumstance. Certain states allow under 18 to be with a parent’s or guardian’s written approval and some of them require it to be notarized. Notification Requirements For Tattooing and Permanent Cosmetic Coloring and For Body Piercing.
(a) Before performing a tattooing and permanent cosmetic coloring procedure or a body piercing procedure on a client, a practitioner shall give written educational information, approved by the board, to the client.
(b) After completing a tattooing and permanent cosmetic coloring procedure or a body piercing procedure on a client, the practitioner shall give written aftercare instructions, approved by the board, to the client.
The written instructions:
(1) must include advice to the client to consult a physician at the first sign of infection;
(2) must contain the name, address, and telephone number of the shop where the procedure was performed;
(3) shall be signed and dated by the client and the practitioner; the practitioner shall keep the original and provide a copy to the client.
(c) The owner of a shop for tattooing and permanent cosmetic coloring or for body piercing shall prominently display
(1) a copy of the statement provided by the board under AS 08.13.030(b) that advises the public of the health risks and possible consequences of tattooing and permanent cosmetic coloring or body piercing, as applicable;
(2) the names, addresses, and telephone numbers of the Department of Commerce, Community, and Economic Development and the Department of Environmental Conservation and a description of how a complaint about the shop or a practitioner in the shop may be filed with either entity or with the board.
Arizona Tattoo Laws

Arizona currently does not require licensure or certification to engage in the practice or business of tattooing, branding, scarifying, implanting, mutilating, tattooing or piercing. Source

Arizona Criminal Code (Arizona Revised Statutes, Title 13).
it is unlawful for a person to do any of the following:
Ø Use a needle, or any substance that leaves color under the skin, more than once.
Ø Use a needle that is not properly sterilized.
Ø Engage in the business of tattooing, branding, scarifying, implanting, mutilating or body piercing out of a home or an impermanent structure, such as a tent or trailer.
Ø If the person is not a licensed health professional, it is unlawful to administer anesthesia during the course of any procedure that involves branding, scarifying, tattooing, implanting, mutilating or piercing the body of another person.
Arkansas Tattoo Laws

Minimum Age (with parent/guardian consent):

Minors may be tattooed (under 18) with written parental consent with the parent present. Source

Notes & Exceptions:

Ears can be pierced with parental consent at age 16 and tattoed with a physicians prescription for repigmentation. Genitals and nipples can not be tattooed or pierced by anyone under 18

Intoxicated/Impaired Individuals:

Anyone under the influence of drugs or alcohol can not be tattooed, pierced or branded

Licensing & Regulation:

Relevant Statute(s) and Rules:

AR Code § 20-27-1509 (2014)
(a) The Department of Health may issue a temporary demonstration license to an artist or establishment or to a supplier of materials for body art for:
(1) Educational purposes where body art is performed;
(2) Trade shows where body art is performed;
(3) Demonstrations of body art products or procedures; and
(4) An appearance as a guest artist.
(b) A temporary demonstration license shall be valid for no more than fourteen (14) consecutive calendar days.
(c) (1) The sponsor of a body art event for an educational purpose, a trade show, a demonstration, or a combination of an educational purpose, a trade show, and a demonstration of body art procedures where body art is performed shall obtain the necessary permits to conduct business in the jurisdiction in which the event will be held, including without limitation a permit issued by the department.
(2) The department shall collect a nonrefundable sponsor fee of fifty dollars ($50.00) per artist who performs body art at an event, not to exceed two thousand dollars ($2,000) per event. (3) In addition to the penalties under § 20-27-1502, a sponsor who violates this subsection is subject to closure of the temporary body art event and a penalty not to exceed three (3) times the cost of the permit.
(d) The department shall levy and collect a nonrefundable fee of fifty dollars ($50.00) from a guest artist for a temporary demonstration license.
(e) (1) An application for a temporary demonstration license shall be submitted to the department not less than forty-five (45) days prior to the event for educational purposes, trade show, or demonstration of body art products and procedures where body art is performed.
(2) An application for a temporary demonstration license shall be submitted to the department not less than seven (7) days before the appearance of a guest artist.
(3) An artist shall provide evidence of completion of Occupational Safety and Health Administration blood-borne pathogens training with the application.
(f) (1) A person applying for a temporary demonstration license to appear as a guest artist shall provide documentation of licensure as an artist in another state or country or employment history in a studio licensed by the regulatory board or agency in another state or country before the temporary demonstration license may be granted.
(2) The establishment where the guest artist is appearing shall have a licensed body artist on its staff.
(3) A guest artist may be issued a temporary demonstration license to appear as a guest artist no more than one (1) time every three (3) months.
(g) A fee levied and collected under this section is special revenue and shall be deposited into the State Treasury, to be credited to the Public Health Fund to be used exclusively for the Body Art Program of the department.
California Tattoo Laws

Minimum Age (with parent/guardian consent):

A minor may be tattooed with parental consent with the parent present for the entire procedure. No genitalia or nipples may be pierced under 18 for any reason.

Notes & Exceptions:

Ears can be pierced with parent consent without them present, but given in writing.

Intoxicated/Impaired Individuals:

No restriction is present for intoxicated persons being tattooed, but use your best judgement

Licensing & Regulation:

Each city has its own rules and regulations for tattoo shops, check with the local authorities for relevant information. State law dictates only registering with local authorities as they deem fit and taking the blood borne pathogen course. Body Art. Cal. Health & Safety Code

CA Health & Safety Code § 119307 (2017)
Temporary Tattoo Registration and Regulations: CA Health & Safety Code § 119317 (2017)
A practitioner may, in the local jurisdiction of registration, practice in a temporary demonstration booth for no more than seven days in a 90-day period. The demonstration booth shall meet all of the following requirements:
(a) Be located within a building that has hand washing facilities with hot and cold running water, soap, and single-use paper towels to which practitioners have direct access.
(b) Constructed with a partition of at least three feet in height separating the procedure area from the public.
(c) Have floor space of at least 50 square feet for each practitioner.
(d) Be free of insect or rodent infestation.
(e) Used exclusively for performing body art.
(f) Equipped with adequate light available at the level where the practitioner is performing body art.
(g) (1) For temporary body art events consisting of one demonstration booth, the booth shall be equipped with hand washing equipment that, at a minimum, consists of containerized liquid soap, single-use paper towels, a five-gallon or larger container of potable water accessible via spigot, and a wastewater collection and holding tank of corresponding size. Potable water shall be refilled and the holding tank evacuated frequently to provide uninterrupted use, or as determined by the local enforcement agency.
(2) For temporary body art events consisting of two or more demonstration booths, practitioner hand wash areas shall be provided throughout the event. The hand wash areas shall be located within a booth with partitions at least three feet in height separating the hand wash area from the public. The area shall be equipped with a commercial, self-contained hand wash station that consists of containerized liquid soap, single-use paper towels, a storage capacity of five gallons or more of potable water, and a trash receptacle. The sponsor shall provide one hand wash area for every two demonstration booths at the event.
(h) Have smooth, cleanable flooring.
(i) No food, drink, or tobacco products are permitted in the demonstration booth.
(j) Not allow animals within the confines of the demonstration booth.
(k) Be operating with all necessary permits to conduct business. In addition to the penalties available pursuant to Article 6 (commencing with Section 119320), a sponsor or practitioner who violates this subdivision shall be subject to closure of the temporary body art event or a penalty not to exceed three times the cost of the permit or both closure and the penalty.
Colorado Tattoo Laws

Minimum Age (with parent/guardian consent):

There is no minimum age for tattoos with parental consent

Form of Parent/Guardian Consent:

Parent must be present during the entire procedure. Tattooing a minor without consent is punishable by a $250 fine

Notes & Exceptions:

Minors can pierce their ears without consent from parents.

Intoxicated/Impaired Individuals:

Persons who are noticeably impaired cannot have any body art done

Licensing & Regulation:

6-601 All provisions of these regulations shall apply with the following exceptions:
(a) Hand wash facilities shall be easily accessible to each procedure area and designated for use by artists only. Hand wash facilities shall comply with 5-506 or, temporary hand wash facilities shall consist of soap, single use paper towels and an adequate supply of potable water dispensed through a continuous flow spout. Wastewater shall be collected and disposed of in a sanitary manner.
(b) Body artists may bring pre-sterilized instruments, or instruments which have been sterilized at another location with documentation showing a negative spore test result within the previous 30 days. On site sterilization units may be used and shall comply with Section 8-803.
6-602 After the last procedure is completed, all procedure areas shall be cleaned and disinfected.
Connecticut Tattoo Laws

Minimum Age (with parent/guardian consent):

No person shall tattoo an unemancipated minor under eighteen years of age without the permission of the parent or guardian of such minor. Tattoos under the age of 14 are completely prohibited

Form of Parent/Guardian Consent:

No person may perform body piercing on an unemancipated minor under eighteen years of age without the written permission of the minor’s parent.

Notes & Exceptions:

Ear piercing on a minor may be done with the parents consent. All other piercings are 18 and over only

Intoxicated/Impaired Individuals:

No restrictions or punishments are in place, but use your best judgement

Licensing & Regulation:

Department of Public Health Each person seeking licensure must document to the Department's satisfaction that the applicant:

Is eighteen years of age or older;

Has successfully completed, within the three years prior to submitting an application, a course on prevention of disease transmission and blood-borne pathogens that complies with the standards adopted by the federal Occupational Safety and Health Administration, as described in 29 CFR 1910. 1030 et seq., as amended from time to time, and that requires the successful completion of a proficiency examination as part of such course;

Holds current certification by the American Red Cross or the American Heart Association in basic first aid;

and verifying completion of two thousand (2,000) hours of practical training and experience under the personal supervision and instruction of a tattoo technician;
OR
Verifying five years of continuous practice of tattooing in this state prior to January 1, 2015.

Please be advised that training hours completed after January 1, 2015 will only be credited if the supervisor was licensed during the period of training.

A person who provides instruction on tattooing techniques or participates in the demonstration of a tattooing-related product or offers tattooing as part of a professional course, seminar, workshop, trade show or other event, may practice tattooing for such purpose, may not be required to hold a license or temporary permit provided such person:

Is licensed or certified in the state, territory or possession of the United States or foreign country that is the primary place where such person practices tattooing if such state, territory, possession or foreign country requires licensure or certification for tattooing;
Has successfully completed a course on prevention of disease transmission and blood-borne pathogens that complies with the standards adopted by the federal Occupational Safety and Health Administration, as described in 29 CFR 1910.1030 et seq., as amended from time to time, within the preceding three years;

Practices tattooing under the direct supervision of a tattoo technician;

Does not receive compensation for tattooing, other than for providing instruction or tattooing services to persons in attendance at the course, seminar, workshop, trade show or event; and

Provides instruction, demonstrates tattooing techniques or offers tattooing only for persons enrolled in the course, seminar or workshop or attending the trade show or event at which the person provides instruction, demonstrates a product or offers tattooing.

Any person or organization that holds or produces a course, seminar, workshop, trade show or other event at which a person who is not a tattoo technician licensed in the state provides tattooing instruction, participates in the demonstration of a tattooing-related product or offers tattooing to persons in attendance at the trade show or event shall ensure compliance with these provisions.

No person shall perform body art procedures if the person is unable to exercise reasonable care and safety or is otherwise impaired by reason of illness, while under the influence of alcohol, or while using any controlled substance or narcotic drug as defined in the 21 USC 802(6) Source

The Department of Consumer and Regulatory Affairs, through the Board of Barber and Cosmetology, shall regulate body artists to protect public health, safety, and welfare, and to ensure that persons engaged in the occupation have the specialized skills, education, and training required to perform the services offered by: To be eligible for a tattoo license you need:

You need 500 hours of apprenticeship or proof of 4,000 hours as a licensed tattoo artist in another state.

Relevant Statute(s) and Rules:

(a) Body art technicians shall perform body art procedures in a licensed body art establishment.

(b) Body art technicians shall use single-use disposable sharps, pigments, gloves, and cleansing products while performing body art procedures on each client.

(c) Verbal and written instructions for the care of the tattooed, pierced, or other modified sites on the body shall be provided by the body artist to each customer upon the completion of the procedure. The written instructions shall advise the customer to consult a physician at the first sign of infection or other adverse reaction and shall contain the name of the body artist and the name, address, and telephone number of the establishment.

(d) Any person who violates this section shall be subject to disciplinary action including license suspension or revocation and a maximum fine of $2,500.

3.0 Preoperational Requirements

3.1 Permits

3.1.1 No person shall operate a body art establishment who does not have a valid permit issued by the Division. Only a person who complies with the requirements of these Regulations shall be entitled to receive or retain such a permit.

3.1.2 An establishment’s valid permit shall be posted in a location easily observed by the customer.

3.1.3 Permits shall not be transferable from person to person or from location to location.

3.1.4 When a body art establishment changes ownership, management firm, or lessee, both the facility and its operation shall be brought into full compliance with these Regulations prior to the issuance of a permit. A variance may be issued, as provided by these Regulations.

3.1.5 Establishments in compliance with these Regulations shall be issued a permit in accordance with Section 3.2 of these Regulations. Establishments that continue to operate without proper permits from the Division or operate in violation of these Regulations will be subject to legal remedial actions and sanctions as provided by law.

3.2 Classification of Body Art Establishment Permits

3.2.1 Permanent permit – a permit issued for businesses that operate at a fixed location. A permanent permit is valid for one year from the date of issuance.

3.2.2 Mobile permit – a permit issued to an enclosed vehicle which meets all the requirements of these Regulations and which does not operate at a fixed location. A mobile permit is valid for one year from the date of issuance.

3.2.3 Temporary permit – a permit issued for educational, trade show or product demonstration purposes only. A temporary permit is valid for fourteen (14) calendar days from the date of issuance.

3.2.4 Restricted permit – a permit issued to an establishment that is not approved to provide full services because of certain limitations. A restricted permit shall not be valid for longer than one year from the date of issuance.
Florida Tattoo Laws

Minimum Age (with parent/guardian consent):

A person may not tattoo the body of a minor child younger than 16 years of age

The department of health licenses and regulates tattoo shops and artists

(1) Except as provided in s. 381.00773, a person may not tattoo the body of any human being in this state unless the person is licensed as a tattoo artist or registered as a guest tattoo artist under this section.

(2)(a) A person seeking licensure as a tattoo artist must apply to the department in the format prescribed by the department. An application must include:

1. The name and residence address of the applicant.

2. The name and street address of each tattoo establishment and temporary establishment at which the applicant intends to practice tattooing in this state.

(b) The department shall issue a license to an applicant who:
1. Is 18 years of age or older.

2. Submits a completed application.

3. Pays the applicable license fee established in s. 381.00781.

4. Submits proof of successful completion of an education course approved by the department on blood-borne pathogens and communicable diseases.
5. Submits proof of passage of an examination approved by the department on the material presented in the education course.

(c) The department shall approve one or more education courses and examinations that allows a person to complete the requirements of subparagraphs (b)4. and 5. in person or through an Internet website.

(d) A tattoo artist must, within 30 days after a change, notify the department of any change in the following information disclosed in his or her most recent application for issuance or renewal of his or her tattoo artist license in the format prescribed by the department:

1. The name and residence address of the tattoo artist.

2. The name and street address of each tattoo establishment in this state at which the tattoo artist has practiced tattooing for more than 14 days since the most recent renewal of his or her tattoo artist license or, if the license has not been renewed, since the license was issued.

(4)(a) A tattoo artist license is valid for 1 year and must be renewed annually. (b) A guest tattoo artist registration is valid for 14 days. A guest tattoo artist may apply for reregistration before or after expiration of his or her current registration. (5) A license or registration issued by the department under this section is not transferable.

Fla. Stat. § 381.00787 Fla. Stat. §381.0775 et seq. A temporary establishment license is valid for the duration of a convention or other similar event for which the license is issued not to exceed 14 consecutive days.

A person seeking registration as a guest tattoo artist must apply to the department in the format prescribed by the department. An application must include:
1. The name and residence address of the applicant.
2. The name and street address of each tattoo establishment and temporary establishment at which the applicant will practice under the guest tattoo artist registration.

(b) The department shall issue a guest tattoo artist registration to an applicant who:
1. Is 18 years of age or older.
2. Submits a completed application
. 3. Pays the applicable registration fee established in s. 381.00781.
4. Holds an active license, registration, or certification issued by a jurisdiction outside this state, whether by another state, the District of Columbia, any possession or territory of the United States, or any foreign jurisdiction, if:
a. The education and examination requirements of the license, registration, or certification substantially meet or exceed the requirements of subparagraphs (2)(b)4. and 5.;
or
b. The applicant submits proof of successful completion of an education course approved by the department under subparagraph (2)(b)4. and proof of passage of an examination approved by the department under subparagraph (2)(b)5. Sources
Georgia Tattoo Laws

Licensing & Regulation:

GA Code § 31-40-2 (2018)

It shall be unlawful for any person to operate a tattoo studio without having first obtained a valid permit for such studio. Such permits shall be issued by the county board of health or its duly authorized representative, subject to supervision and direction by the Department of Public Health but, where the county board of health is not functioning, the permit shall be issued by the department. A permit shall be valid until suspended or revoked and shall not be transferable with respect to person or location.

Universal Citation: GA Code § 31-40-5 (2018)

(a) The Department of Public Health and county boards of health shall have the power to adopt and promulgate rules and regulations to ensure the protection of the public health. Such rules and regulations shall prescribe reasonable standards for health and safety of tattoo studios with regard to: (1) Location and cleanliness of facilities; (2) Sterilization and Occupational Safety and Health Administration guidelines for the prevention and spread of infectious diseases by all personnel; (3) Informed consent by the person receiving a tattoo; (4) Procedures for ensuring adequate explanation to consumers of the proper subsequent care of a tattoo; and (5) Proper use and maintenance of tattoo equipment, including dyes and pigments.

(b) County boards of health are empowered to adopt and promulgate supplementary rules and regulations consistent with those adopted and promulgated by the department.

Military Clause in Georgia

31-40-8.:
546 Each body art studio shall conspicuously display in a prominent place easily seen by 547 patrons a printed sign that warns that any body art on the face, neck, forearm, hand, or 548 lower leg of an individual may automatically disqualify such individual from military 549 service in the armed forces of the United States. Such notice shall be at least 11 inches by 550 14 inches in size, with letters at least one inch in height.

Permit; required for tattoo shop and temporary locations.
(a) No person, partnership, firm, corporation, or other legal entity shall operate a tattoo shop or temporary location without a permit pursuant to department rules.
(b) Each initial permit application under this section shall be accompanied by a fee of $125 for a permit valid for one year. For renewal of a permit, each applicant shall pay a fee of $75 per year. Initial permit application and renewal fees may be increased by not more than $10 per year.

(c) All permits shall expire on December 31 of each year. The application for a permit renewal shall be submitted to the department in writing on or before December 31 annually.

(d) The department may issue a temporary permit valid for a maximum of seven consecutive days per calendar year for locations other than a permitted tattoo shop for the purpose of a trade show, product demonstration, or educational demonstration; provided that the show or demonstration shall meet all safety and hygiene standards as specified by the director and in this chapter. The temporary permit application shall be made in writing to the department at least sixty days prior to the scheduled event, shall include specific measures to meet specified health and safety standards, and may be subject to a site inspection. Temporary permit applicants shall pay a $50 nonrefundable application fee in addition to:

(1) A $500 nonrefundable permit fee for an event featuring not more than forty participating tattoo artists; or

(2) A $50 nonrefundable permit fee for an event featuring less than three participating tattoo artists demonstrating for educational purposes only, without compensation, consideration, or donation by the public;

provided that the department may annually increase the fees specified in paragraphs (1) and (2) by not more than $100 and $10 per year, respectively. [L 2009, c 130, §1]

A person shall not own, control and lease, act as an agent for, conduct, manage, or operate an establishment to practice the are of tattooing or engage in the practice of tattooing without first applying for and receiving a permit from the Iowa department of health.

To obtain a tattoo permit in the State of Iowa, the Artist must complete an application and provide documentation of the following:

Artist must be at least 18 years of age
Artist must have a high school diploma or G.E.D. (on-line diplomas will not be accepted)
Artist must complete Blood-borne Pathogen Training and Standard First-Aid Training
Along with the application, all artists are required to pay an annual, non-refundable fee of $75.00.

All permits expire on December 31 for the year issued.
Your permit will automatically be deactivated after 90 days if not renewed.

A license is valid for only one location. Tattooing and piercing are not allowed in a client’s home, where conditions of sanitation can greatly vary. If you are visiting another licensed body art establishment, you may join them as a guest artist for less than 60 days. 44-003.01 Licensure to practice body piercing, branding, permanent color technology, and/or tattooing:

44-003.01A Requirements: An applicant for a license must:

1. Be at least 18 years of age;
2. Have a high school diploma or General Education Development Certificate (GED); and
3. Have completed at least 4 hours of training within 3 years immediately prior to making application for a license as a body artist. Such training must include:
a. At least 2 hours of Bloodborne Pathogens (disease) training, which includes sanitation, infection control and sterilization. An examination is required as a condition of training completion.
(1) The examination must include questions relating to the following:
(a) Sanitation;
(b) Safety (including emergency procedures);
(c) Infection control including cross contamination and barrier control; and
(d) Sterilization including use of an autoclave; and
b. A basic first aid class which teaches participants how to:
(1) Recognize emergency situations;
(2) Check the scene and call for help;
(3) Avoid bloodborne pathogen exposure;
(4) Care for wounds;
(5) Manage sudden illnesses; and
(6) Minimize shock.
The training may be obtained through any of the following:
1. Nationally accredited organization;
2. Local government sponsored;
3. Hospital sponsored;

New York Tattoo Laws

It is violation of Section 260.21 of New York State Penal Law to tattoo minors under the age of 18, regardless of parental consent. Contact local law enforcement for more information.

Notes & Exceptions:

Effective October 28, 2012, New York State Public Health Law Article 4A. prohibits body piercing on a person under eighteen (18) years of age unless the person provides the body piercing establishment with written consent from a parent or legal guardian. The parent or legal guardian must sign a New York State Department of Health consent form (DOH 5072) in the presence of the owner of the body art establishment or in the presence of the body artist. Written parental consent is not required for piercing of the ear.

Licensing & Regulation:

Statewide health regulations for tattooing and body piercing are currently being developed by the New York State Department of Health under the statutory authority of Public Health Law Article 4A. The law authorizes the Commissioner of Health to develop regulations establishing operating standards, fees, fines and penalties for failure to abide by the regulations. The law requires tattoo and body piercing operators to obtain a permit in order to operate a tattoo or body piercing studio and for all tattoo and piercing artists to obtain an individual permit.

North Carolina Tattoo Laws

15A NCAC 18A .3202 PERMITTING

(a) Every person engaged in the practice of tattooing shall register with their local health department on or before January 1, 1995, by providing their name, the address of the location at which they engage in tattooing, and their hours of operation.
(b) No person shall engage in tattooing on or after June 1, 1995, without first obtaining a tattooing permit issued by the department. Persons permitted to engage in tattooing in counties with local rules shall obtain a tattooing permit from the department on or after June 1, 1995. Nothing herein shall preclude counties with local rules from permitting tattoo artists prior to June 1, 1995, at which time all tattoo artists shall be permitted by the department.
(c) No tattooing permit shall be issued to a person until an inspection by the department verifies compliance with this Section.
(d) Tattooing permits shall be issued in the name of the individual tattoo artist, shall list the address of the tattoo establishment where the artist will practice, and shall not be transferable to another person or place of practice.
(e) A valid tattooing permit shall be posted in the premises of the tattoo establishment in a conspicuous place where it may be easily observed by the public upon entering the establishment.
(f) Application for a tattooing permit shall be submitted to the local health department. The application shall include at least the following information:

(1) Name of tattoo artist;
(2) Mailing address of tattoo artist;
(3) Name of tattoo establishment;
(4) Street address of tattoo establishment;
(5) Anticipated date of commencing operation; and
(6) Signature of tattoo artist.
(g) Any additional information requested by the department to verify compliance with this Section shall be submitted with the permit application. An initial application for issuance of a tattooing permit shall be submitted no less than 30 days before anticipated commencement of tattooing by the artist within the NC Department of Health and Human Service 15A NCAC 18A .3200

Application for renewal of an existing tattooing permit shall be submitted to the local health department at least 30 days prior to the expiration date of the existing permit.
(h) Any permit application fee established by the local board of health shall be paid upon submission of the application.

(B) A parent, guardian, or custodian of an individual under age eighteen who desires to give consent to a business to perform on the individual under age eighteen a tattooing procedure, body piercing procedure, or ear piercing procedure performed with an ear piercing gun shall do both of the following:
(1) Appear in person at the business at the time the procedure is performed;
(2) Sign a document provided by the business that explains the manner in which the procedure will be performed and methods for proper care of the affected body area following performance of the procedure.

To be licensed

A person seeking approval to operate a business that offers tattooing or body piercing services shall apply to the board of health of the city or general health district in which the business is located on forms the board shall prescribe and provide. The applicant shall submit all information the board of health determines is necessary to process the application. The applicant shall include the fee established under section 3709.09 of the Revised Code with the application.

Boards of health shall deposit all fees collected under this section into the health fund of the district that the board serves. The fees shall be used solely for the purposes of implementing and enforcing this chapter.

To receive approval to offer tattooing or body piercing services, a business must demonstrate to a board of health the ability to meet the requirements established by this chapter and the rules adopted under section 3730.10 of the Revised Code for safe performance of the tattooing or body piercing procedures, training of the individuals who perform the procedures, and maintenance of records.

A board of health that determines, following an inspection conducted under section 3730.04 of the Revised Code, that a business meets the requirements for approval shall approve the business. Approval remains valid for one year, unless earlier suspended or revoked under section 3730.05 of the Revised Code. A business's approval may be renewed. Approval is not transferable.

Oklahoma Body Art (Tattoo/Piercer) License Application
Exam Information
After the two years of experience is verified and all of the above documents are received, the applicant will be mailed a Test Letter. Once received, the applicant must select an approved testing location to take the Tattoo/Body Piercing Competency Examination and contact that facility to schedule an exam.
The applicant must present the original Test Letter issued by the OSDH and a valid photo ID to the selected Oklahoma Department of Career and Technology Education approved testing location.
The testing fee will be $200.00, paid directly to Career Tech. (Check with the selected testing location for valid forms of payment.)
The applicant must receive a minimum score of 70% on the written examination that will include:
(1) Knowledge of anatomy, physiology, and disease;
(2) Theory and application of ink;
(3) Safety and aseptic technique;
(4) Professionalism; and
(5) Client consultation services.
If the minimum score of 70% is not met, the applicant can retest up to two (2) times. The applicant must wait at least seven (7) days before retesting. If a passing score is unable to be met after three (3) attempts, the applicant will be required to enroll or re-enroll in an Apprentice Program.
Once the passing score is verified, the Tattoo or Body Piercing Artist License will be mailed to the applicant.
Oklahoma State Department of Health Approved Tattoo Testing Locations

Relevant Statute(s) and Rules:

The State Department of Health shall not grant or issue a license to a body piercing or tattoo operator if the place of business of the body piercing or tattoo operator is within one thousand (1,000) feet of a church, school, or playground.

A body piercing or tattoo operator applying for license renewal or for a new license under subsection C of this section shall publish notice of the license application or renewal at least once a week for three (3) consecutive weeks in a newspaper of general circulation nearest to the proposed location of the business and most likely to give notice to interested citizens of the county, city, and community in which the applicant proposes to engage in business. The publication shall identify the exact location at which the proposed business is to be operated.

To be a tattoo artist in Oregon you must:

Submit documentation of having completed blood borne pathogens training from an Health Licesnsing Office(HLO)-approved provider.
Submit documentation of having completed cardiopulmonary resuscitation and basic first aid training from an HLO-approved provider.
Provide documentation of completing a qualifying pathway (see below).

Applicant must graduate from an Oregon licensed tattooing career school after completing the following required training:

Completion of approved training program including 360 hours of training (210 theory/150 practical), chairside supervision under a licensed tattoo artist.
Must have documentation showing a minimum of 50 completed procedures (which means "a tattoo that has been finished, including any touchups or additional work following initial healing and the client is released from service")
Training must be conducted by an Oregon licensed tattoo artist registered as a teacher by the Higher Education Coordinating Commission's Private Career Schools division.
A registered teacher must provide direct supervision of practical training on a one-to-one student/teacher ratio for students performing practical training while the student is working on the general public. Direct supervision means the teacher is present and actively involved in direct oversight and training of students.
Licensed tattoo schools must submit official transcripts directly to the Health Licensing Office.
Take and pass a written examination.

Pursuant to R.I. Gen. Laws § 23-1-39, no person shall engage in the practice of tattooing or hold himself/herself as a tattoo artist in this state unless he/she is registered in this state under the statutory and regulatory provisions of this Part. Provided, that physicians duly licensed to practice medicine in the state of Rhode Island under the provisions of R.I. Gen Laws Chapter 5-37, shall be exempt from this registration requirement. However, a physician engaged in the practice of tattooing in his/her private office shall be required to register the site as a tattoo parlor/shop and meet the requirements of § 15.5 of this Part.
15.4.1 Qualifications A. Any applicant seeking registration in this state must:
1. Be over 18 years of age;
2. Be of good moral character;
3. Demonstrate knowledge of aseptic tattooing technique via inspection, as indicated in § 15.4.3 of this Part; and
4. Have completed an apprenticeship program as outlined in this Part or has shown equivalent documentation of education/experience in the art of tattooing/permanent makeup.

15.4.3 Registration of Tattoo/ Permanent Makeup Artists and Apprentices
A. By Examination

1. Applicants and apprentices who have completed an apprenticeship program, seeking registration as a tattoo/permanent makeup artist, shall be required to demonstrate aseptic tattooing technique via an examination administered by the registration agency, to test the applicant's fitness to engage in the practice of tattooing/permanent makeup. Such examination shall test the applicant's knowledge and practices of infection control and such other areas as may be deemed necessary, and shall be administered upon completion and review of the application.
a. Applicants who have not satisfactorily met the application requirements of this Part relating to the examination described in § 15.4.3(A)(1) of this Part will be given two (2) additional opportunities to demonstrate tattooing technique. Failure to meet all technique requirements will result in denial of registration.
b. Applicants wishing to reapply for registration may do so after a six (6) month waiting period between attempts at the examination.
B. Apprenticeships

1. Persons wishing to begin an apprenticeship program at an established tattoo parlor must register with the registration agency within thirty (30) days of beginning a tattoo parlor’s apprenticeship training program.
2. A tattoo parlor’s apprenticeship training program must span eighteen (18) months from the apprentice registration date and should be inclusive of the following:
a. Practical Operation: 150 hours
b. Aseptic Tattooing Technique: 50 hours
c. Anatomy and Physiology: 30 hours
d. Skin and Skin Disorders: 20 hours
e. Aftercare Instruction: 10 hours
f. Equipment and Supplies: 20 hours
g. Rhode Island Rules and Regulations for Tattoo Artists and Tattoo Parlors: 20 hours
3. Upon completion of a tattoo parlor’s training program, documentation of training must be presented with the tattoo license application to the registration agency for review and processing.
4. Parlor patrons receiving a tattoo/permanent make up procedure from an apprentice must be informed prior to the tattoo/permanent makeup procedure in writing, and acknowledge via a dated signature, that they willfully accept the tattoo/permanent makeup procedure to be performed by an apprentice.
5. The licensed tattoo artist trainer must be present at all times during procedures performed by the apprentice.
South Carolina Tattoo Laws

(C) A tattoo artist must verify by means of a picture identification that a recipient is at least eighteen years of age. For purposes of this section, "picture identification" means:
(1) a valid driver's license; or
(2) an official photographic identification card issued by the South Carolina Department of Revenue, a federal or state law enforcement agency, an agency of the United States Department of Defense, or the United States Department of State. Proof that the defendant demanded, was shown, and reasonably relied upon proof of age is a defense to an action brought pursuant to this section.

A tattoo artist must be at least twenty-one years old and must possess a certificate of successful completion, on an annual basis, of a course in blood borne pathology and tattoo infection control as approved by the department, a current American Red Cross First Aid Certification and Adult Cardiopulmonary Resuscitation (CPR) Certification obtained either from the American Red Cross or the American Heart Association. A tattoo artist must conspicuously display in a public area on the premises of the tattoo facility the certificates of successful completion of a course in CPR, first aid, blood borne pathogens, and tattoo infection control.

No person shall operate a tattoo studio unless the person is registered with the state as an operator or as an artist and the studio has been issued a studio certificate by the local health department. No studio certificate shall be issued or renewed unless the studio has been inspected and found to be in compliance by the local health department.

No person shall engage in the practice of tattooing or act as a tattoo artist unless the person has registered as a tattoo artist with the department of health. A statewide tattoo artist license shall be issued and is transferable within this state to any studio holding a current studio certificate issued by a local health department. The department of health may, at its option, direct the local health department to act in its behalf in the application, examination and collection of funds concerning tattoo artist registration.

n order to receive a tattoo artist license, the tattooist shall be trained in the profession of tattooing to include sterilization methods in a certified shop for at least one (1) year, under a currently licensed tattoo artist who has been certified and operating in compliance with applicable laws in this state for no less than three (3) years. Out of state tattoo artists must be able to show proof of at least two (2) years' experience as a professional tattoo artist in another state. Source

62-38-205. Temporary locations. (a) A registered tattoo business may set up at temporary locations other than a tattoo studio, e.g., tattoo conventions, with the written approval of the local health department, for a period not to exceed ten (10) days; provided, that each artist not previously registered with the department of health shall register and pay a fee of fifty dollars ($50.00) to the department.
(b) Temporary facilities, e.g., tattoo conventions, shall be held to the same sanitary standards as those required of tattoo studios. Temporary facility permits shall be issued by the local health department, to include:
(1) An area where tattooing can be performed in a limited access location;
(2) Adequate sterilization equipment supplied;
(3) Waste receptacles and sharps containers supplied;
(4) Individual containers of water for each client in single use rinse cups; and (5) Disinfectant sprays at each tattoo artist's work area.
(c) A temporary tattoo artist registration may be issued for no more than fourteen (14) days. The holder of the studio certificate shall also sign for the temporary license from the department of health and all tattooing shall be under the auspices of the studio certificate holder and in compliance with this part. Artists may apply tattoos if a copy of the state application and a receipt for the fifty dollar ($50.00) fee is on display at the studio. The sterilization course, written examination and work experience shall be waived for the temporary permit. A temporary license is not transferable nor may it be renewed.

§ 4105. Apprenticeship requirements for license

(a) Initial registration.
(1) A person who intends to engage in the practice of tattooing, permanent cosmetics, or body piercing in this State shall register with the Office of Professional Regulation and shall pay the required fee.

(2) Registration shall be in the form required by the Director and shall include such information as the Director may require concerning the location of the registrant's practice, the registrant's qualification, and the nature of the services offered.

(b) Tattooists and body piercers.
(1)(A) As a prerequisite to licensure, a tattooist or body piercer applicant shall provide proof of an apprenticeship of at least 1,000 hours of experience obtained within two calendar years working under the direct supervision of a body piercer or tattooist licensed and in good standing with this State or the state in which he or she is regulated, and who has been in practice a minimum of three years.

(B) Proof may be in the form of a sworn affidavit from the supervising tattooist or body piercer, including information as the Director may reasonably require on forms provided by the Director.

(2) Apprenticeships shall include successful completion of a three-hour course in universal precautions and infectious diseases.

(3) Apprentices shall contact the Office for the appropriate forms prior to beginning the apprenticeship.

(4) As used in this subsection, "good standing" shall mean that the tattooist or body piercer supervisor holds a current, unrestricted license in this State or an unrestricted authorization to practice tattooing or body piercing in another state. A tattooist or body piercer who holds a restricted license or restricted authorization to practice may petition the Director for permission to be a tattooist or body piercer supervisor, which may be granted by the Director for good cause shown.

Shops
A shop shall not operate in this State without first registering with the Office of Professional Regulation and paying a fee of $100.00. Registration shall be in the form required by the Director.

(1) A shop shall not be granted registration unless the shop complies with this chapter and rules adopted under this chapter.

(2) All shops shall designate a person who is licensed under this chapter in the practice of tattooing or body piercing, who shall be responsible for overall cleanliness and sanitation of the shop.

(3) The practice of tattooing or body piercing shall be permitted only in registered shops.

(4) The practice of permanent cosmetics may be performed anywhere the practice of tattooing is permitted, on the premises of a health care professional licensed pursuant to this title, or on premises meeting the sanitation requirements of this chapter as determined by the Director or as set forth by rule.

Except as permitted in § 18.2-371.3 of the Code of Virginia, a client must be a minimum of 18 years of age and shall present at the time of the tattooing or permanent cosmetic tattooing a valid, government issued, positive identification card including, but not limited to, a driver's license, passport, or military identification. (a) Tattoo studios in West Virginia shall obtain a West Virginia business registration certificate and shall register with their local orregional board of health.

(b) Each local or regional board of health shall conduct annual inspections of each tattoo studio to determine compliance with this article. Every person, firm or corporation operating a tattoo studio in West Virginia shall apply to their local or regional board of health for the inspection. The local or regional boards of health shall attempt to conduct the inspections within ten days of the receipt of the request for inspection: Provided, That if it is impracticable for the local or regional board of health to conduct the investigation within ten days after receiving the application, the boards may issue to the applicant a temporary operating permit which shall be valid for thirty days or until a regular inspection is made, whichever occurs first.

No person may tattoo or body pierce another person, use or assume the title of tattooist or body piercer, or designate or represent himself or herself as a body piercer unless the person has obtained a license from the department by application made upon a form furnished by the department under sub.
